Contract basis
General terms and conditions of business
§ 1 Provider, Scope and Definitions
- These terms and conditions apply to contracts for hairdressing and cosmetic services, the sale of goods, and the issuance of their own vouchers between the Kirstin Ellen Vietze Hairdresser & Cosmetics GmbH, Dorotheenstraße 60, 10117 Berlin (hereinafter referred to as „KEV GmbH“), and its customers.
- A customer is any natural or legal person who enters into a contract with KEV GmbH. All mandatory consumer protection regulations apply to consumers. A consumer is any natural person who enters into a legal transaction predominantly for purposes that are neither related to their commercial nor their independent professional activity.
- Individual agreements take precedence over these terms and conditions. Any differing terms and conditions of the customer shall only apply if KEV GmbH has expressly agreed to them.
- For vouchers purchased or services booked through third-party providers, the terms and conditions of the respective provider may also apply. The contracting parties, scope of services, and applicable terms and conditions must be clearly identifiable before the transaction is concluded.
§ 2 Appointment scheduling and contract conclusion
- Appointments can be made in person at the salon, by phone, per e-mail, above WhatsApp or via the Online booking at e-cut can be requested or booked.
- For bookings arranged personally or individually via telephone, email, or WhatsApp, the contract is concluded as soon as the customer and KEV GmbH have reached a binding agreement on the essential points, in particular the service and date. A mere inquiry does not constitute a booking.
- For online bookings, the contract is concluded according to the description displayed during the booking process before the booking declaration is submitted. A purely technical confirmation of receipt only acknowledges receipt unless it is explicitly designated as acceptance. If a separate appointment confirmation is provided, the contract is only concluded upon receipt of this confirmation.
- If a person makes a booking demonstrably on behalf of another customer, the legal rules regarding representation apply. The booking itself does not automatically confer power of representation.
- KEV GmbH will provide the customer with the contractual terms and conditions, including these General Terms and Conditions and, where a statutory right of withdrawal exists, the cancellation policy on a durable medium, insofar as this is legally required.
§ 3 Prices, Additional Services, Payment and Default
- The price applicable is the price displayed before the conclusion of the contract or individually agreed, including the legally owed value added tax.
- If the price depends on factors such as hair length, hair volume, material consumption, time required, or the desired result, this will be explained transparently before booking or, if an assessment is only possible on-site, before the service begins. The basis for calculation or a price range will be provided whenever possible.
- Additional services and significant price increases that were not apparent at the time of contract conclusion will only be carried out with the customer's prior consent. The customer may request a cost estimate before the commencement of services.
- Legal information obligations regarding total price, price calculation and payment methods for online bookings remain unaffected.
- Unless otherwise agreed, payment is due upon completion of the service or delivery of the goods. KEV GmbH accepts the payment methods specified prior to payment.
- The statutory regulations apply to late payments. For consumers, default without a reminder occurs no later than 30 days after the due date and receipt of an invoice only if the invoice specifically points out this consequence.
§ 4 Down payments, special orders and advice
- A deposit is only required if explicitly agreed upon. Before payment, the amount, due date, purpose, and allocation to the booked service will be communicated. The deposit will be credited towards the final invoice.
- For individually ordered extensions, hairpieces, or special products, it is agreed transparently before ordering whether and to what extent the customer will bear procurement costs. Whether or not there is a right of withdrawal for goods manufactured according to customer specifications or clearly personalized depends solely on the statutory provisions.
- Consulting services are only charged if they have been separately agreed upon in advance as a paid service. The price and content will be communicated before the consultation begins.
- If the contract terminates before full performance, KEV GmbH may only retain or offset a deposit to the extent that it has a valid claim. Saved expenses, alternative use of products, and replacement bookings will be taken into account. The customer may prove that there is no claim or that the claim is significantly less.
- In the event of a valid statutory cancellation, payments will be refunded in accordance with statutory regulations via the originally used payment method, unless expressly agreed otherwise. A legally mandated refund is not limited to a voucher.
§ 5 Vouchers
- Purchased gift vouchers can be redeemed at the salon for services and goods offered there, unless otherwise agreed at the time of purchase. Cash refunds are excluded, subject to mandatory legal provisions. Remaining balances are retained until the statute of limitations expires.
- Claims arising from paid vouchers are generally subject to the regular limitation period of three years. This period typically begins at the end of the year in which the claim arose and the creditor obtained, or should have obtained without gross negligence, the legally required knowledge.
- For service vouchers, a co-payment may be required if the price of the specified service has increased after issuance and the voucher clearly only reflects the value paid at the time of issuance. The specific voucher description is decisive.
- For promotional or advertising vouchers issued free of charge, the terms and conditions of the promotion, which were communicated transparently at the time of issuance, may apply. Mandatory statutory rights remain unaffected.
- For vouchers from a third-party provider or an independent online shop, the terms and conditions of purchase, redemption, and cancellation apply. KEV GmbH is only liable to the extent that it is itself a contractual partner or legally responsible.
- For contracts concluded online concerning vouchers, there is a statutory right of withdrawal, unless a statutory exception applies.
- Transferable vouchers are redeemable upon presentation. In case of loss, theft, or damage, a claim for compensation exists only in accordance with statutory regulations; if the voucher can be blocked and the balance reliably verified, KEV GmbH will examine a replacement solution.
§ 6 Participation and health information
- The customer shall inform KEV GmbH before the start of treatment about any known allergies, intolerances, illnesses, medications or prior treatments, insofar as these may be relevant for safe and professional treatment.
- KEV GmbH may refuse or modify treatment for objective reasons, particularly if there are health risks, information is lacking, or the desired outcome is deemed professionally irresponsible. Payments for services not rendered will be refunded; statutory rights remain unaffected.
- KEV GmbH explains the essential risks identifiable for the specific treatment. A particular result is only guaranteed if it has been expressly agreed upon. Statutory warranty rights remain unaffected.
§ 7 Cancellation, revocation, termination and no-show
- Statutory revocation: If a consumer contract concluded online or outside of business premises has a statutory right of withdrawal, the customer may exercise this right irrespective of the following cancellation rules. No compensation for lost revenue will be demanded if the contract has been effectively withdrawn. Legally permissible compensation for services actually rendered up to the point of withdrawal remains unaffected.
- Contractual cancellation: Appointments are binding once booked. Customers should notify the service of any cancellations as early as possible. Cancellations received at least 48 hours before the scheduled appointment are generally free of charge. Cancellations can be made via the provided contact methods; legally permissible means of communication remain unaffected.
- Late cancellation and no-show: In the event of cancellation less than 48 hours before the appointment or in the case of a no-show, KEV GmbH may demand compensation for the demonstrably incurred loss, or foreseeable loss based on the ordinary course of events, provided there is a legal or validly agreed basis for this. The claim is limited to the agreed price. Saved expenses and any full or partial replacement booking will be deducted. Double billing will not occur.
- The customer may prove that no loss or a significantly smaller loss occurred. In the event of a disputed claim, KEV GmbH will provide a comprehensible explanation of which services and time were reserved, which expenses were saved, and whether alternative bookings were possible.
- Short-term booking: If an appointment is booked less than 48 hours in advance, no automatic flat fee is charged. The decisive factors are, in particular, the response time available since booking, the specific cancellation, saved expenses, alternative bookings, and any statutory right of withdrawal.
- Termination: If the customer terminates a service or work contract or otherwise dissolves it, remuneration and claims for damages are governed by statutory regulations and the specific circumstances of the case. This provision does not establish any additional claims for KEV GmbH.
§ 8 Delay and cancellation by KEV GmbH
- The customer should arrive on time and inform the customer of any foreseeable delay.
- In the event of a significant delay, KEV GmbH may, by mutual agreement, shorten or adjust the service or, if the overall schedule cannot otherwise be met, refuse to perform the service. Compensation or damages will only be claimed to the extent permitted by law; the full price will not be due solely due to a delay without prior review.
- If KEV GmbH has to cancel an appointment, the customer will be informed as soon as possible and offered an alternative appointment if feasible. No payment is owed for services not rendered; any payments already made will be refunded. Statutory rights remain unaffected.
- In the event of force majeure or unforeseeable failure of essential supplies, the rights of both parties are governed by the statutory provisions.
§ 9 Minor Customers
- Contracts with minors are subject to the statutory rules regarding legal capacity. An age limit alone does not automatically render a contract valid. Where necessary, the consent or approval of the legal representative must be provided.
- For safety reasons, chemical treatments, especially coloring or permanent waves, are not offered to customers under 16 years of age.
- For customers aged 16 and over who are still minors, KEV GmbH only performs chemical treatments with the prior consent of their legal guardian and after a professional assessment. KEV GmbH may require the presence of the legal guardian at the initial consultation and may refuse treatment if it has concerns.
§ 10 Defects, complaints and purchase of goods
- The statutory warranty rights and limitation periods apply to services, works and goods.
- Customers are requested to report any apparent defects as soon as possible. Prompt notification facilitates investigation and rectification. This request is not a deadline and does not restrict statutory rights.
- KEV GmbH will generally be given the opportunity to review the complaint and, where legally permitted, to remedy the situation. Statutory rights in the event of failure, unreasonableness, or dispensability remain unaffected.
- Unauthorized alterations by the customer or another salon can complicate the inspection. Legal rights are not automatically forfeited; the decisive factor is whether the alteration was the cause of the defect or damage.
- For goods sold by KEV GmbH, it remains the point of contact for warranty claims to the extent permitted by law. Claims are not automatically referred to the manufacturer. Opening packaging does not automatically preclude statutory rights.
§ 11 Liability, Cloakroom and Valuables
- KEV GmbH is liable without limitation in cases of intent and gross negligence, in cases of culpable injury to life, body or health, under the Product Liability Act, on the basis of an assumed guarantee and in all other cases of mandatory statutory liability.
- In cases of slight negligence resulting in a breach of a material contractual obligation, liability is limited to the foreseeable, typical damages at the time of contract conclusion. Otherwise, liability for property damage and financial losses caused by slight negligence is excluded to the extent permitted by law.
- The limitations also apply in favor of the legal representatives and agents of KEV GmbH.
- Customers are requested to remove jewelry before treatment and not to leave valuables unattended. KEV GmbH is liable for loss or damage according to the above rules; liability for its own negligence is not generally excluded.
- If, despite a professionally justified warning, the client requests treatment, the consultation and decision will be documented. Legal obligations and liability for one's own negligence remain unaffected; services that are not professionally justifiable may be refused.
Section 12 Data Protection
- Personal data is processed in accordance with applicable data protection regulations. Depending on the process, this may be done in particular for the implementation of pre-contractual measures, for the performance of a contract, for compliance with legal obligations, or on another legal basis.
- Details can be found in the separate document. Privacy Policy.
§ 13 Final Provisions
- Customer declarations are not subject to any stricter form than legally permissible. Individual agreements remain unaffected.
- German law applies. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection afforded by mandatory provisions of the state in which they have their habitual residence.
- A choice of jurisdiction agreement is only valid if and to the extent that it is legally permissible and effectively agreed upon. For consumers, the statutory places of jurisdiction apply.
- Should any provision be or become wholly or partially invalid, the remaining provisions shall remain in full force and effect, to the extent permitted by law. The invalid provision shall be replaced by the applicable statutory regulations.
